Smyrna Police Arrest Local Man for Lewd Public Act

Smyrna PD patrol officers recently arrested a 19-year-old Clayton man for committing a lewd act inside of a local business. On Wednesday 2/10/21 at approximately 5:30 pm, patrol officers responded to the Dollar General located in the 100 block of E Glenwood Ave for a report of a male who had been masturbating in the aisle of the store, in view of patrons and employees. Officers were provided with a description of the suspect and immediately began canvassing the area. An officer on patrol located the suspect walking on Main St in the area of North St. The suspect fled on foot upon seeing Police. Officers continued their canvass and again located the suspect in the area of W Glenwood Ave and School Ln. The suspect again fled on foot and was apprehended a short time later a few blocks away. The suspect was identified as Herbert Hillman, 19 of Clayton. Further investigation revealed that Mr. Hillman was banned from the Dollar General for a similar previous incident in 2019. Mr. Hillman was transported to SPD and charged with the following crimes:


Resisting Arrest, Lewdness, and Criminal Trespass 3rd. Mr. Hillman was arraigned via video court in JP #2. He was released on his own recognizance pending a future hearing in Kent County CCP.
