Smyrna Police arrest man for home invasion shooting incident

Smyrna Police arrested a man for a home invasion shooting moments after it occurred. On 9/3/21 at approximately 7:35 p.m., SPD officers responded to the 100 block of Lincoln St for a report of a shooting. Once on scene, a large crowd was contacted. Residents of the street quickly assisted Police in identifying Jehoshaphat Martinez, 23 of Dover as the shooter. Mr. Martinez was taken into custody without incident. Investigation revealed that Mr. Martinez entered an occupied residence without permission and began firing rounds from a handgun at the multiple residents including children inside. Detectives recovered a 9mm handgun as well as shell casings from the scene. No one was injured as a result of the gun fire. Mr. Martinez was arraigned on the following charges via video court in JP #7;

Possession of a firearm during the commission of a felony

Home invasion 1st degree

2 counts Possession of a firearm by a person prohibited

Carrying a concealed deadly weapon

7 counts Reckless Endangering 1st degree

Criminal Mischief over $1000-

After arraignment, Mr. Martinez was committed to Sussex Correctional Institute in lieu of $98,000 cash bond pending a future court hearing.
